Handling of Disputes
Level9Trips is committed to providing 100% customer satisfaction, so if you have a problem or dispute with our product or service, we will make every effort to resolve it as soon as possible. However, you may pursue claims as outlined in the following sections if we are unable to do so.
By doing business with us, you consent to give us the chance to resolve any disagreements you may have with our Privacy Policy, the Website, our agents, or any services or products we provide. You can do this by contacting the Level9Trips Customer Service division. In the event that we are unable to resolve your claims by the date we mutually agreed upon, you may file a small claims lawsuit or request mediation, as indicated in this section.
All claims will be resolved through binding arbitration, not in court, unless you bring a claim individually in small claims court. This includes any claims you make against us, our affiliates, or companies that offer products or services through us. This also includes claims that arose prior to your acceptance of the stated Terms of Use, whether or not an earlier version of the Terms required arbitration.
The mediation process does not need a judge or jury, and the court has limited authority to examine the mediation award. But, a mediator must abide by and enforce these Terms & Conditions just as a court would, and they can provide damages and relief on an individual basis just like the court does.
The mediation will be conducted by the American Arbitration Association (AAA) in line with its own set of rules, which also includes the AAA Consumer Regulations. Except as stipulated in this section, all filing, administration, and mediation fees shall be paid in accordance with the AAA's regulations. The mediation may take place in person in the state where you reside, over the phone, based on written submissions, or in a different location that has been agreed upon..
Any and all claims resolution proceedings shall be conducted solely on an individual basis, without any consideration of class, consolidated, or delegated actions. This agreement is subject to the Federal Arbitration Act and federal mediation legislation. Any court with jurisdiction to do so may affirm a mediation decision.
